Divorce laws in Australia are based on a no fault principle, that no one is at fault for the divorce. Before you can apply for a divorce, you need to satisfy the court that you and your spouse have lived separately for at least 12 months, and you have to prove to the court that there is no reasonable likelihood of resuming the relationship. It is however possible, to live together in the same home and still be seen as separated.
